Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you and the1prompt ("we," "our," or "us") governing your access to and use of the website the1prompt.com and all related services (collectively, the "Service"). By creating an account or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
the1prompt is an AI prompt library and optimizer platform. It allows users to browse and use curated AI prompts, optimize their own prompts using AI models, and (for eligible creators) publish and monetize prompts. The Service is provided "as is" and may change at any time.
3. Accounts
You must sign in with a valid Google account. By authenticating, you represent that you are at least 13 years old and that the Google account belongs to you.
You are responsible for all activity that occurs under your account. You must notify us immediately at elias@donbot.ai if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or remain inactive for an extended period.
4. Subscription Plans and Payments
The Service is offered under multiple plans: Free, Pro ($9/month), and Business ($29/month). Plan features and limits are described on the Pricing page.
Paid plans are billed in advance on a monthly basis through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Cancellations: You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period — you will retain access until then and will not receive a prorated refund for unused time.
Refunds: All payments are generally non-refundable. Exceptions may be made at our sole discretion for extraordinary circumstances — contact us within 7 days of a charge.
We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Generate content that is illegal, harmful, threatening, abusive, or defamatory
- Infringe the intellectual property rights or privacy of any person or organization
- Attempt to bypass plan limits, rate limits, or access controls through automated means
- Reverse-engineer, scrape, or bulk-download the prompt library without written permission
- Distribute malware or engage in phishing or fraud
- Resell or sublicense access to the Service without our written consent
Violation of this section may result in immediate account termination without refund.
6. User Content
You retain ownership of any prompts or content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and (if you publish it) make it available to other users as part of the Service.
You represent that you have the rights to submit any content you provide and that it does not violate any third-party rights. We reserve the right to remove content that violates these Terms.
7. Intellectual Property
All software, design, trademarks, and curated content comprising the Service — excluding user-submitted content — is owned by or licensed to the1prompt and is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
8. Third-Party Services
The Service integrates with third-party providers including Google (authentication), Stripe (payments), and various AI model providers. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.
9. Disclaimers
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated content may be inaccurate — use it at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, the1prompt and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claim arising under these Terms is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless the1prompt and its affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time for any reason, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 6–11 survive termination.
13. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms will be resolved in a court of competent jurisdiction located in the United States.
14. Changes to These Terms
We may revise these Terms at any time. When we make material changes, we will notify you by email or a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms.
